It's been a while since I looked up the rules but I recall when you display a price whether you display "inc" or "plus" VAT should depend upon the customer - that's why most builders merchants have +VAT prices, because their customers will be claiming the VAT back anyway... but HMV will be selling "inc. VAT"

It won't be plus vat, if that is the case the advert must state that. "VAT qualifying" is a term used on certain cars used for business purposes. A VAT qualifying car is one that has been used ON

I fully agree, but a car is not usually classified as a commercial vehicle hence the different VAT treatment. VAT cannot be reclaimed on cars bought by a business which attract any form of private use

Anyhow, the situation has been clarified and I would suggest that any such advert placed on PHeads is aimed directly at Joe Public and that said advert is misleading.

I see that the advert has now been amended.

Below is an extract from the Autotrader site under the heading of "misleading adverts" which reflects my understanding of non commercial vehicle advertising.

If advertising cars for sale It is a legal requirement for dealers to place adverts which must include the full sale price inclusive of VAT.  This is because these sites are primarily used by consumers.  We have been advised by Trading Standards that ads priced +VAT, on our main site, are breaking legislation and should be changed.
