Steve you are very right about if the dealer proceeds with the work and Lotus denies the warranty. The dealer would indeed foot the bit if they continued without authority.

There are several instances of Lotus doing just that on here.

Steve - your contract for purchase is with the supplying dealer so your consumer rights including right to reject and right to expect a product fit for purpose and of reasonable quality, longevity etc. are pursued through them. The responsibility re fitness for purpose etc. is on top of the warranty, the warranty does not replace ststutory rights etc.as the warranty is a seperate contract that is over and above.

@C8RKH, the points in your post 5 up from this are absolutely correct. I went through the process of successfully rejecting a LR late last year which was 12 months old at the time.

Many dealers will put every obstacle in your way and try to confuse you but, as long as you understand the CRA 2015 Act, perseverance usually pays as long as you do your homework and do things by the book.

its 2 years old now and needs a new engine - already had a gearbox rebuild

Had conformation from dealer today that the warrenty had been rejected due to modifications to the car and that i had over reved the engine due to a missed downghange 😫,

Lotus have looked after me ....

I would have only modded the car outside the warranty period if at all.

And why did you mod it before your first track day?

Why not try out the car as is on the track, and if there had been any problems, Lotus would have had to look into it for you and  you would have most likely been covered under the warranty.

Now you have a fight on your hands.......!!

Sorry to hear about your issues.  Our Exige 350 gearbox did exactly the same thing on our first trackday ever at Bedford.  There were quite a few other Lotus guys there who all had a poke around, but our track day finished after 3 laps.  Lotus sent a tech up and agreed to fit a brand new gearbox under warranty.  The car had not been altered in any way though.

Really pleased for you @Turbo911 and glad it has all worked out well. I really could not see how an auto blipper would invalidate the warranty for a gearbox UNLESS it had caused an over rev which can be checked through the ECU.

When you get the chance can you report back on the experiences with the auto blipper. I can't heel & toe and am too old to start learning now so would be interested in this for my 410.  Thanks.

IMO, the blipper oh the dreaded blipper, Fab bit of kit i had it installed by a specialist and its easy peasy to set up and it works superbly i dont use it on the road much as there is no need unles you were realy pushing on if i bought a new manual lotus would i buy another yes I would you never know but lotus might introduce one on its manual cup cars in the futre like on the gt3 porkas.........
